5:00 pm
well in san jose. >> this is all believed to be connected to a dangerous bank robbery suspect who's on the loose. take a look at sky 7 video here right now. this area is shut down. there's a live shot from sky 7. trying to keep neighbors away from what might possibly be an explosive situation. let's talk everybody through what's going on here. this is a man who was seen running. this is to a construction site in san jose and you can see he's wearing black clothing, mismatched shoes. construction workers were on the scene. this happened like about 90 seconds to two minutes ago. construction workers have since left the area. i apologize for the video breaking up. this is near mission and 6th in san jose. >> okay. we don't know if that is the person they're looking for, but they see someone by the description of black t-shirt, black pants, we're told one brown shoe, one white shoe that ran into the building.
5:01 pm
it is a construction site. the workers have left. and again, they have their guns drawn. that area closed off. 6th and mission. police have locked down that entire block, that surrounding area. it does appear there there's the one brown shoe fitting the description. >> so police have got this area as kristen said locked down and they're going to approach this building. there were two openings there and they're not sure if it's the bank robbery suspect, but obviously they didn't bring all these police out for no reason. so that's what the premise is, that this is the man they have been looking for over 24 hours after a bank robbery in the south bay. >> a little more on that background, larry. it all began yesterday, of course, when a man rocked a bank of america branch in scots valley. right now let's go to david louie for the very latest at the scene. david? >> reporter: inside the area where the search is under way we have seen first a foot chase is
5:02 pm
going on by san jose police who are here and you can see all the construction workers are still outside here. this is a construction zone from the ground level where this suspect has been holed up and where they have been trying to find him. occasionally we have heard from the helicopter a p.a. system the officers telling him to get on the ground, get on the ground, but he has not complied. he's continued to run and elude the police. sky 7 is overhead as you can see right now looking at the active police scene. i just saw a canine unit go by. they are arresting the suspect right now i understand on the other side of the building so we are finally getting a break in the case. that appears to be on the 10th street side of this construction site. we're at 10th and taylor street just north of san jose's japantown. we see one of the s.w.a.t. team units, the special response units, driving toward me right now off to the left side and they have got this area totally surrounded so this suspect was
5:03 pm
not going to get out of this square block, very large square block where a major construction project is under way. to the left side of what you're looking at is the gordon biersch brewing company. sky 7 has the best view of what's going on. the suspect is down on the ground. as kristen and dan mentioned, the man has two different kinds of shoes on his feet. very distinctive. they were able to find him very quickly. what we don't know is whether or not the unmarked police vehicle that was stolen overnight might have been dumped somewhere in this area. we've been sort of trying to scan the area to see if it's here. we're not sure how he got to this part of san jose. he was up in the lexington hills, up by redwood estates, but now sky 7 shows us from overhead it has now been zeroed into the near east side of san jose. startling all these construction
5:04 pm
workers who were busy working, their hard hats still on their heads. they're also wondering what to do next because some of them cannot get to their vehicles right now. we are going to see whether we can talk to someone who might know something about what happened and we're going to see whether or not we can get a first person account. excuse me, did you see the suspect running? >> no. >> you did not? you did not see him running? what were you doing when you were told to leave the construction site? >> i was on the third floor packing up my stuff. i got a call from the office and they told me to evacuate everybody on site. >> reporter: how many people do you have on the job site? >> 70 people. >> reporter: did you hear police cars responding, that type of thing? >> well, we heard the helicopter over there and we didn't think we were in trouble or anything. and then everybody just came swarming in over here like, what, 20 minutes ago. so they called us to evacuate everybody on site, police are on site with guns ready to shoot, get everybody out. so right now they call me, i
5:05 pm
guess they caught the guy so we're good to go back and pack our stuff. >> reporter: are you surprised this was a good place to hide? >> this is a perfect place to hide. you could go under a sheet of plywood and they never would have caught him. >> reporter: we're glad you're safe. get back to work, get your things and enjoy your weekend. so there we have it, a first-person account of how this area had to be evacuated. we'll be waiting to see where the suspect is brought out. once he's apprehended, he's going to be handcuffed and taken away. there are some very upset agencies who have been working very hard trying to get him apprehended or get him under arrest. he's eluded them since mid-morning yesterday after that bank robbery in scots valley. what has been difficult for many people, of course, is the fact that he wore a hoodie, a full face mask, he wore a hoodie and, therefore, it was hard to describe exactly what he looked like. and then he changed clothes. he broke into a house last night, he took a van, changed
5:06 pm
his appearance and then of course stole the unmarked police vehicle from a residence early this morning. so there's been a lot of effort that has gone into this, a lot of manpower, a lot of canine units as well that have been searching, trying to catch his scent and try to track him down. as we say, we don't know exactly which way he's going to be coming out. once they apprehend him. but we're sure there must be a vehicle here to transport him to jail as soon as they can. that's what we have right now. we're live in downtown san jose. david louie, abc 7 news. >> all right, david, thank you. it certainly looks like at this point that the situation has ended, judging from the relaxed stances of the officers and the smiles on the construction workers' faces. hopefully it has ended. again, hopefully with no injuries and no shots fired, anything like na. >> and the assumption, again, is this is the bank robber they have been searching for the past 24 hours. we have no confirmation at this point but we'll update you as
5:07 pm
soon as we get information. you'll have it and we'll put it on the website and the abc 7 news app. our other top story tonight, the outcry after the latest executive order from president trump. >> this afternoon at the pentagon, the president signed an order he says will keep radical islamic terrorists from entering the united states. >> i'm establishing new vetting measures to keep radical islamic terrorists out of the united states of america. we don't want them here. >> the white house just released a full text copy of the order, the four-page document includes a 120-day ban on all refugees. it also ends the syrian refugee program indefinitely. refugees may be admitted in the meantime if officials determine that a person is a religious minority in their country and facing religious persecution. civil rights groups and many elected officials across the country and here in california are furious about this tonight.
5:08 pm
>> nancy pelosi of san francisco put out a statement and tweeted this administration has mistaken cruelty and prejudice for strategy. this is not who we are as a country. and the minority leader of the senate, chuck schumer, tweeted there are tears running down the cheeks of the statue of liberty tonight. bay area representative zoe lofgren tweets this plays right into isis recruitment efforts. mike pence tweeted calls to ban muslims from entering the u.s. are offensive and unconstitutional. pence has not commented on this latest order. if you want to read the order itself, we have it posted on our website, abc7news.com. some immigrant families did not show up today at a san francisco community center one day after armed federal agents dropped in on the center asking about individuals. >> abc 7 news reporter kate larson is live at the center. kate, agents say this was all an accident, apparently? >> reporter: yeah, that's right.
5:09 pm
you know, larry, kristen, they say perception is reality. for the hundreds of immigrants that use this community center, even an accidental appearance by i.c.e. agents can create so much fear that people decide to hide at home. >> i start like panicking because i have always been afraid of immigration, even though i'm legal now. >> reporter: she 'grated to california 30 years ago. her three sons were born and raised in san francisco, and yet today she is too scared to show her face or give her full name. this after immigration agents showed up at her mission district community center. >> i'm originally from mexico. i'm afraid that i'm going to be deported to a place where i haven't been for a long time. >> reporter: surveillance video shows four i.c.e. agents outside the good samaritan resource center around 9:20 yesterday morning. at the time good samaritan's preschool was in session and the three-story building was full of families. >> they created a lot of fear
5:10 pm
because we just were not aware of what was happening. >> reporter: the executive director says one i.c.e. agent came into their lobby and told an employee they were looking for two people at 1290 potrero avenue w avenue, which was the apartment complex next door. you can see them leave and try to get into the locked gate. u.s. immigration and customs enforcement says one of their bay area fugitive operations teams was looking for a convicted sex offender who they want to deport, but the timing and location of the i.c.e. agents' search scared families so much that many didn't show up to the center today. >> we serve a large number of families, many are immigrants. and obviously this also happened the day after the announcement by the president of some pretty strict enforcement policies on immigrati immigration. >> reporter: i also spoke to two of hilda's young sons today.
5:11 pm
at 6:00 we'll hear from them and who they say they're afraid of losing to deportation. also where the immigration enforcement agency is in their search for the missing sex offender. i'm kate larson, abc 7 news, back to you. >> all right, thank you. new information and video tonight from alameda county sheriff's investigators in their efforts to solve the murder of a castro valley grandmother. andrea st. john was skilled last month. abc 7 news reporter laura anthony has the story. >> reporter: it's a surveillance video that shows a man walking late at night in a castro valley neighborhood. a man police hope can help solve the murder of andrea sangt john 12 days before christmas. sheriffs are also looking for a car seen in the neighborhood around the same time. a 2011 to 2013 toyota corolla like this one. >> we're not naming this person as a suspect, but we're saying they're a person of interest, maybe either a witness or
5:12 pm
somebody that we need to alleviate as being involved in this case. >> reporter: a widow, a mother and grandmother, st. john was found dead inside the garage of her home, a house that had been set on fire the night of december 13th. an autopsy revealed that st. john was murdered before the fire. neighbors tell us they haven't been able to rest easy in the weeks since st. john's murder here and they won't until police make an arrest. >> and i'm deathly afraid every day. >> reporter: franny irwin can see st. john's gutted home from her front porch almost directly across the street. >> so it's definitely a hard time for everybody. i used to see more people out. we don't see anybody anymore. everybody is locked in their homes. >> we have no idea anybody would want to hurt her. >> reporter: police don't know yet why st. john was killed, whether she was targeted for some reason or perhaps sbrup interrupted a burglar or confronted an intruder in her home. laura anthony, abc 7 news.

5:15 pm
>> there are 56 schools in the vast mt. diablo unified school district and thousands of parents at five of the schools want out. yard signs have cropped up everywhere in neighborhoods around bancroft, and other elementary schools along with foothill middle school and north gate high school. >> and we see this secessionist movement as not only short-cited but incredibly -- >> many don't want a separate school district. >> so we are looking at a new school district that would be predominantly white and the students at our schools currently who are intra district transfers will not be at our school sites anybody. >> reporter: we're not changing anything. the seats in our schools are exactly the same. we're following the attendance area set out by mt. diablo school district. >> reporter: the founder of the movement called caps says it's all about low performance numbers district wide and having local control. >> we just believe mt. diablo is
5:16 pm
too large. it's 32,000 students. >> reporter: those who want to create a new district collected 6,000 signatures on petitions so the issue will now go before the county this spring. it would then go to the state and could potentially ending up on the ballot in 2018. mt. diablo unified school district's superintendent declined to go on camera but said this week they adopted a resolution to oppose the schools trying to leave the district. >> and it's not at all in i think the best interest of the district to allow this to continue, and it's unfortunately been very divisive and very negative. >> reporter: some teachers say the digs on social media have gotten personal, as the war over spinning off a new school district accelerates. in walnut creek and concord, i'm leslie brinkley, abc 7 news. a lease proposal unveiled by the raiders for a new stadium in las vegas is raising some eyebrows. under this proposal the raiders are seeking to pay just $1 a year in rent and receive all
5:17 pm
revenue from naming rights on the stadium. the team calls the proposal a starting point in negotiations. the state of nevada has already approved $750 million in taxpayer money for that facility. that's a record amount. the raiders applied for relocation to las vegas last week. league owners are expected to vote on the application in late march. right now the raiders pay $3 million in annual rent at the coliseum in oakland. the 49ers pay $24.5 million at levi's stadium. security experts worry that president trump's penchant for tweeting could be making him vulnerable for hackers and spies. the issue is trump's cell phone. apparently the president has continued to use his personal android device to tweet. a uc berkeley expert says the phone, a samsung galaxy s-3 is easy to crack. >> exploiting a phone like that is something that you can assign for homework because it's already known how you exploit it. you look at these techniques. once you can get the victim to click on the link, you take over
